of DIS ONE Distillery No. ONE for Mail Order Sales in Germany.
We would like to point out that we do not sell our alcoholic products to persons under the age of 18. By placing an order, you explicitly confirm that you meet the required legal age.
1. Scope of Application
These General Terms and Conditions (GTC) apply to all orders and deliveries made via our online shop between you and DIS ONE Distillery No. ONE, Waldstraße 8, 88486 Kirchberg, Germany.

3. Conclusion of Contract
3.1 The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order. Errors and technical inaccuracies are reserved.
3.2 By clicking the “Order” button, you submit a binding offer. You will then receive an email confirmation of your order’s receipt. This confirmation email does not yet constitute an acceptance of the offer but merely documents the order’s receipt. The purchase contract is concluded as soon as you receive an order confirmation from us via email.
4. Prices and Shipping Costs
4.1 The prices listed in the online shop are in Euros and include the legally required VAT.
4.2 In addition to the indicated prices, we charge shipping costs. The exact amount will be clearly communicated during the ordering process. Any customs duties or import fees for international orders must be borne by you.
4.3 Deliveries via this online shop are only available to customers based in Germany.
4.4 If appropriate distributors are available in a given country and we are legally permitted to deliver there, we may do so. Direct delivery to private customers outside Germany is excluded. Large orders must be requested and confirmed in writing in advance.
5. Delivery
5.1 Delivery is carried out by a transport company commissioned by us.
5.2 The delivery time within Germany is usually 3-5 business days. Delivery times within the EU may vary depending on the destination country.
5.3 If partial deliveries occur, you will not incur additional shipping costs. This will be communicated in advance.
5.4 If the ordered goods are unavailable, we reserve the right to withdraw from the contract. In such cases, we will inform you immediately and refund any payments made without delay.
6. Payment
6.1 Payment can be made via advance payment, credit card, PayPal, or any other payment method offered in the online shop.
6.2 In the case of advance payment, the goods will be shipped after receipt of payment.
7. Retention of Title
The goods remain our property until full payment of the purchase price.
8. Warranty
The statutory warranty rights apply.
9. Liability
If the damage is caused by an intentional or grossly negligent breach of duty by us or one of our legal representatives or agents, we assume unlimited liability.
We are also liable for the slightly negligent breach of essential obligations only for foreseeable, contract-typical damage. Essential obligations are those whose breach endangers the contract’s purpose or whose fulfillment enables the proper execution of the contract and on which you regularly rely.
We do not assume liability for the slightly negligent breach of obligations other than those mentioned above.
These liability limitations do not apply to damages resulting from injury to life, body, or health, for defects after assuming a guarantee for the product’s condition, or for fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
If our liability is excluded or limited, this also applies to the personal liability of employees, representatives, and agents.
10. Applicable Law and Jurisdiction
All legal relationships between the contracting parties are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Biberach an der Riss.
11. Right of Withdrawal
11.1 Consumers within the meaning of § 13 BGB have a fourteen-day right of withdrawal.
11.2 The withdrawal period is fourteen days from the day you or a third party designated by you, who is not the carrier, took possession of the goods.
11.3 To exercise your right of withdrawal, you must inform us, DIS ONE Distillery No. ONE, Waldstraße 8, 88486 Kirchberg, Germany, by mail or email at office@dis-one.de, with a clear declaration of your decision to withdraw from this contract. A sample withdrawal form is provided at the end of these GTCs.
11.4 To meet the withdrawal deadline, it is sufficient to send the notice of exercising the right of withdrawal before the withdrawal period expires.
11.5 In the event of a withdrawal, the goods must be returned in a condition corresponding to their inspection. Damaged or opened goods are excluded from the right of withdrawal if they are sealed products whose seal has been removed after delivery.
If the withdrawal is approved, you will only have to compensate for any loss in value of the products if this loss in value results from handling the goods beyond what is necessary to establish their nature, characteristics, and functionality.
12. Final Provisions
If any provision of these General Terms and Conditions is invalid, the purchase contract remains otherwise valid. The statutory provisions apply in place of the invalid provision.
